Organic Pet Food Regulations: Effective Date Delayed

This final rule, issued by the Agricultural Marketing Service (AMS) of the USDA, concerns amendments to the USDA’s organic regulations. Specifically, it addresses clarifying standards for organic mushrooms and, importantly, A Pet Food. This document announces a temporary delay in the effective date of this rule.

The original rule, published on December 23, 2024, aimed to refine the requirements around several key aspects of organic production, including mushroom substrate composition and the sourcing of mushroom spawn. It also detailed composting requirements specific to organic mushroom production, along with composition and labeling standards for organic pet food. Furthermore, the rule addressed the permissible use of certain synthetic substances, such as taurine, in organic pet food formulations.

The effective date of the final rule amending 7 CFR part 205, initially set for December 23, 2024, and then slated for February 10, 2025 (89 FR 104367), is now delayed until March 21, 2025. Organic operations must comply with the requirements of this rule by March 22, 2027.

The delay is in response to the memorandum issued by the President on January 20, 2025, titled “Regulatory Freeze Pending Review.” This memorandum called for a temporary pause on the implementation of new regulations to allow for further review and consideration.

The rule addresses a number of important standards related to organic production. Regarding mushrooms, the rule clarifies standards for mushroom substrate composition and sourcing of mushroom spawn. It also details composting requirements for organic mushroom production.

Of particular note for pet owners and the pet food industry, the final rule also clarifies the composition and labeling requirements for organic pet food. This includes addressing the use of certain synthetic substances, including taurine, a common ingredient in pet food to support feline health. The regulations help define what constitutes genuinely organic pet food.

This action is exempt from notice and comment under 5 U.S.C. 553 and is applicable immediately upon publication in the Federal Register, based on the good cause exceptions in 5 U.S.C. 553(b)(B) and 553(d)(3), respectively. This temporary delay allows Department officials the opportunity for further review and consideration of the regulations, consistent with the President’s memorandum.

In conclusion, the effective date for the final rule concerning organic mushrooms and organic pet food has been delayed until March 21, 2025, with a compliance date of March 22, 2027. This delay allows for further review of the regulations, particularly those related to the composition, labeling, and permissible ingredients in organic pet food, ensuring clarity and consistency in the organic standards.
